Terms of Service

1. Acceptance of terms

By using echoflow ("the Service") you accept these Terms of Service. If you do not accept them, do not use the Service. If you use the Service on behalf of an organisation, you represent that you have authority to bind it to these terms.

2. Description of the Service

echoflow is a service that, from an audio or video file uploaded by the user or given as a link, generates derived content (transcripts, subtitles, summaries, social posts, SEO materials and more) via artificial-intelligence providers, and provides tools to share it to your own channels. The Service may evolve over time with added or changed features.

3. Account

To use the Service you must create an account providing truthful and up-to-date data. You are responsible for keeping your credentials confidential and for all activity under your account. You must be at least 18 or the legal age to enter into a contract in your country.

4. User content

You retain ownership of the files you upload and the content generated from them ("Content"). You grant us a limited, non-exclusive licence necessary to process, store and display your Content and, when you use the share buttons, to generate the public preview pages needed to share it. You are solely responsible for the Content you upload and publish.

5. Prohibited content

The categories below are a closed list: they are exactly what the automated check, when it is active, looks for in uploaded files, and exactly what content can be suspended for. Do not use the Service to upload or generate:

• child sexual abuse material, or material that sexualises minors;
• propaganda, symbols or claims of terrorist organisations, and instructions for carrying out attacks;
• real graphic violence: open wounds, mutilation, corpses, executions, abuse of people or animals;
• explicit sexual acts or genitals exposed in a sexual context, including between consenting adults (echoflow is a service for professional content: this is a product choice, not a judgement);
• hate symbols, gestures or slogans against a group based on ethnicity, religion, sexual orientation, gender identity or disability;
• incitement or instructions for suicide, self-harm or eating disorders.

5-bis. What is NOT prohibited

An automated check makes mistakes, and mostly in one direction. The following is allowed and should not be flagged: non-sexual nudity (art, breastfeeding, medical or educational context, anatomy); brief clothing, swimwear, fitness, dance, combat sports; recognisable fictional violence (films, series, video games, special effects, animation); clinical or journalistic images in an informative context, including wounds in a report or a lecture; weapons shown without violent use.

If the automated check, when it is active, flags legitimate content by mistake, the job stops but nothing is consumed or deleted: someone on our team reviews it and, if it is a false positive, processing resumes on its own.

5-ter. Other prohibited uses

You also agree not to use the Service to:

• upload or generate content that is defamatory, or that infringes third-party rights (including copyright) or others' privacy;
• violate the terms of the platforms you share content on;
• attempt to compromise, overload or circumvent the Service's security measures;
• resell or redistribute the Service without authorisation, except as provided by the Pro plan (white-label).

5-quater. How we enforce these rules

Before processing begins, we may run an automated security check on uploaded files: antivirus and a content check on a few frames sampled from the video. The check does not decide on its own: if it flags something, the job is put on hold and someone on our team reviews it before any decision.

If the violation is confirmed: public share links already distributed stop working, the minutes reserved for that job are consumed and not refunded, and for serious or repeated violations the workspace may be suspended. Content prohibited by the first three categories of section 5 is preserved and, where the law requires it, reported to the competent authorities.

If you receive a link to content published through echoflow and believe it violates these rules, your copyright or your privacy, you can report it from the reporting page, with no account needed: from the shared link or from the site footer.

6. Plans, minutes and payments

The Service is offered with a free 14-day trial (60 processing minutes, up to 10 videos, no credit card) and in a paid plan, Pro, available in two sizes (200 or 1,000 minutes a month). When the trial ends the account remains accessible and the content already produced stays readable and downloadable file by file, but no new processing can be started. Processing consumes minutes: one minute of processed content consumes one minute of balance. It is the same unit that earlier versions of these Terms called a «credit»; the name changed, not the ratio. Paid plans renew automatically until cancelled; payments are handled by our provider (Stripe). If you are a consumer, the right of withdrawal described in section 7 applies to payments. We may update prices with notice.

The prices shown (plans and minute packs) are final amounts in euro.

7. Right of withdrawal (consumers)

If you purchase as a consumer — that is, for purposes outside your trade, business, craft or profession — you have the right to withdraw from the contract within 14 days of entering into it, without giving any reason (arts. 52 ff. of the Italian Consumer Code, Legislative Decree 206/2005).

To withdraw, it is enough to tell us with an explicit statement, for example by writing to support@echoflow.it. You may use the model form below, but you are not required to: any unequivocal statement is valid.

echoflow is a digital service and is available immediately after payment. For this reason, before every purchase we ask for one explicit confirmation, with a box that is never pre-ticked: with it you accept these Terms, ask for the service to start immediately, during the withdrawal period, and state that you understand that, if you withdraw, you will pay for the part of the service already provided. Starting immediately does not take away your right of withdrawal: if you withdraw within the 14 days we refund what you paid, less an amount proportionate to the service provided up to the moment you told us you were withdrawing (art. 57(3) of the Italian Consumer Code).

How we calculate the part already provided. For a subscription we take the larger of two shares: the days elapsed since the start of the paid period compared with its length, and the processing minutes used compared with those included in the period. For a minute pack we take the minutes used from that pack compared with those purchased: plan minutes are always used before pack minutes, and among packs the oldest goes first, so a pack you haven't touched yet is refunded in full. For an upgrade to a larger size (for example from 200 to 1,000 minutes) we take the larger of the days elapsed since you paid the difference compared with the period it covers, and the minutes used out of those the new size added. The refund is the remaining part of the amount paid, rounded down to the cent, and is returned within 14 days of your notice using the same payment method you used. When you withdraw from a subscription the plan ends immediately; when you withdraw from an upgrade you go back to your previous size, which stays active; in every case the unused minutes of that purchase are removed from your balance.

We keep the date, time, version of these Terms and the confirmation given at every purchase, and email you a copy along with the contract confirmation.

Withdrawal does not concern the free trial, which involves no payment and can be abandoned at any time without notice.

8. Third-party services and providers

The Service relies on AI providers and on payment and email providers. The Service does not connect to your social accounts: you are the one who publishes, and sharing content on social platforms is subject to the terms of the respective platforms. We are not responsible for the availability or decisions of such third parties.

9. Intellectual property

The Service's software, brand and content (excluding your Content) belong to echoflow and are protected by applicable law. You acquire no rights to them beyond the use permitted by these terms.

10. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind. AI-generated outputs may contain errors or inaccuracies: you must review them before use or publication.

11. Limitation of liability

To the extent permitted by law, echoflow is not liable for indirect, incidental or consequential damages. Our total liability is limited to the amounts you paid for the Service in the 12 months preceding the event.

12. Suspension and termination

You may stop using the Service at any time. We may suspend or close accounts that violate these terms. On termination, Content may be deleted as described in the Privacy Policy and the Data deletion page.

13. Changes to the terms

We may update these terms; material changes will be communicated through the Service. Continued use after they take effect constitutes acceptance of the updated terms.

14. Governing law and contact

These terms are governed by Italian law. If you use the Service as a consumer and live in another country of the European Union, the choice of Italian law does not deprive you of the protection afforded to you by the mandatory rules of your country of residence. You may also bring any dispute before the courts of the place where you live, and we may bring proceedings against you only before those courts.
